Sweet Leaf Free Press Summer Fest Sweepstakes Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

THE FOLLOWING PROMOTION IS INTENDED FOR VIEWING IN THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA ONLY AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT PROCEED IN THIS SITE IF YOU ARE NOT LOCATED IN ONE OF THE 50 UNITED STATES OR D.C. AT THE TIME OF ENTRY.

1. Eligibility: Sweet Leaf Free Press Summer Fest Sweepstakes (the “Promotion”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least thirteen (13) years old at the time of entry. Employees, contractors, directors and officers of Sweet Leaf Tea Company, and their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children and their respective spouses) and household members of each such employee are not eligible. Subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor's decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.

2. Sponsor: Sweet Leaf Tea Company, 3601 S. Congress Ave., Suite D-100, Austin, TX 78704.

3. Timing: The Promotion begins on May 24, 2011 at 12:00:00 a.m. Central Time ("CT") and ends on May 28, 2011 at 11:59:59 p.m. CT (the "Promotion Period"). Sponsor's computer is the official time-keeping device for the Promotion.

4. How to Enter: The Promotion consists of a sweepstakes (“Sweepstakes”). During the Promotion Period, participants may enter the Sweepstakes by submitting a comment on The Sip Blog. Go to http://sweetleafteablog.com (“Website”) and follow the instructions to comment on the featured Sip Blog post of the day with your favorite Grannyism (“Blog Entry”). Blog Entrants will be entered into the Daily Drawing based on the information submitted at the time of entry.

5. How to Win The Sweepstakes: The Sweepstakes consists of four (4) daily drawings (each a “Daily Drawing”). During the Promotion Period, Sponsor will conduct 4 (4) Daily Drawings, one for each day, as determined by Sponsor. For the purposes of this drawing a “Day” is defined as listed below. The Daily Drawings will be conducted as follows:

On or about each Daily Drawing Date, one Daily Winner for the corresponding Day will be selected in a random drawing by an independent judge selected by Sponsor from among all eligible entries for the specific Day, received from entry method prior to the Daily Drawing Date. Entries are eligible only for their corresponding Day and will not be included in other Daily Drawings.

6. How To Win the Contest: Blog posts will be posted on the Blog beginning May 25, 2011. Beginning May 25, 2011 until May 28, 2011 visitors to the Blog can comment on the featured daily blog with their favorite Grannyism. Limit one Comment per person/email address/Facebook account/Twitter account per entry. Any attempt by an entrant and/or his/her family/friends to comment more than the number of times authorized herein using multiple names or email address and/or any other fraudulent mechanism, as determined by Sponsor in its sole discretion, shall give Sponsor the right to disqualify entrant in its reasonable discretion. The one (1) entrant randomly selected will be deemed the Sweepstakes Winner subject to verification.

7. Winner Verification: Each Potential Sweepstakes Winner (parent/legal guardian if winner is a minor in his/her state of residence) will be required to sign and return an Affidavit of Eligibility, Liability & Publicity Release ("Affidavit"), which must be received by Sponsor within five (5) days of the date notice or attempted notice is sent, in order to claim the prize. If a potential winner cannot be contacted, or fails to sign and return the Affidavit within the required time period, potential winner may forfeit any prize won. Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Sponsor may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded. Prizes will be fulfilled approximately 48 hours after signed Affidavit has been received by the Sponsor.

8. Prizes: There is a maximum limit of one (1) Daily Giveaway Prize per person throughout the Promotional Period. FOUR (4) SWEEPSTAKES PRIZES: A total of Four (4) Sweepstakes winners will receive tickets to Free Press Summer Fest. Sponsor will not replace any lost, mutilated, or stolen tickets. Sponsor is not responsible if concert is delayed, postponed or cancelled for any reason, in which event that portion of prize is forfeited in its entirety and no substitution will be provided except as in Sponsor's sole discretion. Approximate Retail Value (“ARV”): $45-100. Actual value may vary based on differences in concert ticket prices. Winner will not receive difference between actual and approximate retail value. Prize is non-transferable, not redeemable for cash and no substitution will be made except as provided herein at the Sponsor's sole discretion. Sponsor reserves the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use. Limit: One (1) Sweepstakes prize per person/email address/Twitter account. Total ARV of all prizes: $800.

9. Release: By receipt of any prize, winner agrees to release and hold harmless Sweet Leaf Tea Company, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any prize or Sponsor’s use of entrant’s Photo. The winner shall bear all risk of loss or damage to their prize after it has been delivered.

10. Publicity: Except where prohibited, participation in the Promotion constitutes winner's consent to Sponsor's and its agents' use of winner's name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media now known or hereinafter invented, worldwide, without further payment or consideration.

11. General Conditions: Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being the authorized account holder. Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Entrants agree that (a) under no circumstances will participants be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (b) all causes of action arising out of or connected with this Promotion, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (c) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. BY SUBMITTING A PHOTO, ENTRANT ACKNOWLEDGES THAT HIS/HER PHOTO MAY BE POSTED ON SPONSOR’S WEBSITE, IN SPONSOR’S DISCRETION. Submission of a Photo grants Sponsor and its agents an unlimited, worldwide, perpetual, license and right to publish, use, publicly perform the Photo in any way, in any and all media, without limitation, and without consideration to the entrant. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to entrants. By submitting a Photo, entrant agrees that his or her submission is gratuitous and made without restriction, will not place Sponsor under any obligation, Sponsor is free to disclose or otherwise use the ideas contained in the Photo on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you. Entrant acknowledges that, by acceptance of entrant’s Photo, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than entrant. By accepting a Contest prize, each Contest winner agrees that his or her Photo will be deemed a Work Made For Hire under the Copyright laws of the United States, but if it cannot be so deemed, then the winner irrevocably assigns and transfers to Sponsor all of his/her right, title and interest in and to his/her Photo, including all but not limited to all copyright and trademark rights which he or she may have, in the United States and worldwide, therein, for consideration, the receipt and sufficiency of which is hereby acknowledged. Each Contest winner hereby waives in favor of Sponsor, all rights of “Droit Moral” or “Moral Rights of Authors” or any similar rights or principles of law that winner may now or later have to his or her Photo. Sponsor reserves the right to alter, change or modify the winning Photo, in its sole discretion. Upon request of Sponsor, winner shall execute and deliver such additional instrument of assignment, as may be solely deemed by Sponsor, reasonably necessary to establish the ownership of record of the right, title and interest in and to the Photo and of the copyrights transferred and “Moral Rights of Authors” waived under these Official Rules. Should Sponsor fail to request the said assignment as stated, that shall not be deemed a waiver of Sponsor’s rights and Sponsor may at a later time request the assignment.

12. Limitations of Liability: Neither Sponsor, Released Parties nor their agencies are responsible for lost, illegible, late, misdirected, incomplete, mutilated, or non-delivered Twitter or Website Entries, emails or votes; or for interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, garbled, corrupted, scrambled, delayed or misdirected transmissions, or computer hardware or software or telephone malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information, or the failure to capture, or loss of, any such information. Sponsor, Released Parties nor their agencies are not responsible for any incorrect or inaccurate information, whether caused by Website users, or by any equipment or programming associated with or utilized in this Promotion; and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of the Website. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry or voting process or operation of the Promotion or Website, to be acting in violation of the terms of the Website or to be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person. Sponsor and its agencies are not responsible for injury or damage to participant, participant's computer or any other person’s computer related to or resulting from participating in this Promotion or downloading or copying materials from or use of Website. If, for any reason, Promotion, in the sole opinion of Sponsor, is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures or any other causes which, in sole opinion of the Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend Promotion, and determine winner from eligible entries received prior to action taken, or as otherwise deemed fair and equitable by Sponsor. If such malfunction, error, disruption or damage occurs, and impairs the administration, security, fairness, integrity or proper play of the Promotion, Sponsor may, in its sole discretion, suspend or terminate the Promotion by posting a notice on [http://www.sweetleafsweetspot.com]. In case of dispute, authorized subscriber of e-mail account used to enter at actual time of entry will be deemed to be the participant, and must comply with these Official Rules. The authorized account subscriber is deemed to be natural person who is assigned an e-mail address by an ISP, on-line service provider, or other organization that is responsible for assigning e-mail addresses.

In no event will Sponsor or its respective parents, affiliates, subsidiaries and related companies, their advertising or promotion agencies or all of their respective officers, directors, employees, representatives and agents be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of your access to and use of the Website or downloading from and/or printing material downloaded from said Website. Without limiting the foregoing, everything on this Website is provided “as is” without warranty of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose or non-infringement. Some jurisdictions may not allow limitations of exclusion of liability for incidental or consequential damages or exclusion of implied warranties, so some of the above limitations or exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding these limitations or exclusions. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT AS PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.

13. Governing Law/Jurisdiction: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE PROMOTION SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF TEXAS, WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS. BY ENTERING, ENTRANTS CONSENT TO THE JURISDICTION AND VENUE OF THE FEDERAL, STATE AND LOCAL COURTS LOCATED IN TRAVIS COUNTY, TEXAS.
